You can legally change and use a different last name anytime that you want; however, if you get married, you will be able to get your last name changed for free through the city. If you did not get married, and you are interested in getting a last name change, then you will have to pay a fee to the city in order to change your last name. In a common law marriage, you are considered to have the same rights and obligations as a couple in an actual marriage meaning under any legal purpose. It does not mean that you are married though, and so to change your last name legally, you will have to pay a fee to the city and sign the paperwork to have the name change legal. This will include having your passport and all other documents change the legal last name that is indicated.
